TERMS AND CONDITIONS

NIKE wants you to be active, have fun, and join a growing number of NIKE enthusiasts who are running and we have therefore created this event ("The Grid") to encourage that activity. However, NIKE can't be everywhere you are to make sure you are running safely. So, to make sure you know that you need to be accountable for your own safety while running, we ask that you take a minute to read this message and terms and conditions set out below.

1. By registering for The Grid, you agree to be bound by these terms and conditions and any entry instructions, guidance and requirements published on www.nikegrid.com (the "Terms and Conditions"). The Grid is partially or wholly sponsored, produced, directed, organised, conducted or paid for by Nike (UK) Limited ("NIKE").
2. In order to take part in The Grid, you must register on line at www.nikegrid.com and you will receive email instructions on how to take part and a code (a "Pin Code").
3. You must be aged 18 or over on 23 April 2010 to take part in The Grid.
4. Whilst any official participation in The Grid will conclude at 8pm on 24 April 2010, Pin Codes will continue to function until 14 May 2010. Whilst participants using Pin Codes after this date will no longer be eligible for any prizes or any other official benefits, you will still be able to track your progress online for entertainment purposes only.
5. You agree that the information submitted in your online entry form (and any other information supplied by you to NIKE or any other third party in relation to The Grid is true and accurate.
6. You agree that you will not disclose your Pin Code to or share your Pin Code with any third party.
7. NIKE and other associated parties may photograph, film or record the voice of participants taking part in The Grid and at any associated activities or events for advertising, promotional or other commercial purposes. You hereby consent and agree that photographs, film, video and voice recordings may be taken and made of you whilst participating in The Grid and associated activities or events.
8. You irrevocably grant NIKE, its group companies and third party commercial partners the right indefinitely and throughout the world, without any expectation of compensation to: (i) use your photograph, video or film portrayal, image, likeness, voice and any other means which identify you; and (ii) use any biographical or other information or data relating to you (including statistics regarding your participation in The Grid) in any media, including but not limited to, print, audio, visual, audio-visual, virtual media the internet, mobile telephony and so-called "3-G" technologies, CD-Rom or DVDs, television, product catalogues and brochures, point-of-purchase videos and displays, and any other printed or written material in connection therewith, for the purpose of advertising, promoting, marketing, and selling NIKE's products, promoting The Grid or promoting NIKE's brand and activities.
9. You agree and consent to NIKE using your personal details provided in your online registration form for the following purposes:
   1. to record your registration details;
   2. to keep records of your personal performance times, placings and progress, details of which will be posted on www.nikegrid.com; and
   3. to send you information by email and/or SMS relating to The Grid and other NIKE running events and further news and promotional information as you may have requested on your online registration form.
10. Your user name as provided on your online registration form may be posted/displayed on various websites, digital bill boards, Twitter, Facebook, and phone boxes to mark your progress or achievements during your participation in The Grid.
11. All information relating to you collected by or on behalf of NIKE from which you can be identified will be recorded electronically and will be used at all times in accordance with the Data Protection Act 1998. NIKE will not disclose any such information to third parties, save as expressly stated under the Terms and Conditions. You are entitled to withdraw your consent to categories of e-mail and/or SMS communications from NIKE and can do so at any time by either:
    1. following the opt-out instructions provided in the relevant e-mail/SMS;
    2. amending your preferences for alerts by clicking on "My Settings" at www.nikegrid.com; or
    3. by writing to NIKE (UK) Limited, Camberwell Way, Doxford International Technology Park, Sunderland, Tyne and Wear, SR3 3XN.
12. To delete your profile from NIKE's database, please write to NIKE (UK) Limited, Camberwell Way, Doxford International Technology Park, Sunderland, Tyne and Wear, SR3 3XN.
13. You acknowledge that an active participant profile, valid e-mail address and SMS contact number will be required at all times in order for the you to receive important information regarding The Grid and you hereby consent to you receiving such information.
14. You acknowledge and agree that your participation in The Grid involves inherent risks of accidents and injury and that participation in The Grid is at your own risk. You are responsible for running safely, taking adequate rest breaks and consuming sufficient food/drinks. Don't run by yourself and always carry a mobile phone with you at all times.
15. As far as is permitted by law, NIKE accepts no liability for any injury, loss (including indirect, consequential and pure economic loss), damage, claim, demand, expenses or any other liability of any kind of or to you, your property or any other person directly or indirectly arising out of or in connection with your participation in The Grid unless it is due to the gross negligence of NIKE.
16. NIKE will not provide you with any insurance in respect of life, travel, medical or liability, for any illness, accident, injury, loss, or damage for or to either you or any third party that may arise in connection with your participation in The Grid or your attendance at any related event. If you require insurance of any kind, you must obtain it yourself at your own expense.
17. You confirm that you will not publish or post to any website or other media operated by NIKE or otherwise related to The Grid, any text, statement, photograph, image or other material which is obscene, blasphemous, defamatory, infringes the intellectual property of other legal rights of any third party or is otherwise unlawful, offensive or inappropriate. NIKE will have the right to remove any material at its discretion and take appropriate legal action against any person found to be or alleged to be in breach of this term.
